ماده واحده - پروتکل مورخ 1979 راجع به پنجمین تمدید کنوانسیون تجارت گندم 1971 به شرح ضمیمه که در ماه مه 1979 از طرف نماینده دو لت جمهوری اسلامی ایران بامضا رسیده است تصویب و به و زارت امور خارجه اجازه داده میشود که در مورد مبادله اسناد مربوط اقدام لازم به عمل آو رد.

مقدمه
کنفرانس مسئول تهیه متون پروتکل های 1979 برای پنجمین تمدید
کنوانسیونهای تشکیل دهنده موافقتنامه بینالمللی گندم 1971
با توجه به اینکه موافقتنامه بینالمللی گندم 1949 در سالهای 1953، 1956، 1959، 1962، 1965، 1966، 1967، 1968، 1971، 1974، 1975، 1976 و 1978 اصلاح، تجدید یا تمدید شده است
و با توجه به اینکه موافقتنامه بینالمللی گندم 1971 متشکل از دو سند قانونی جداگانه - کنوانسیون تجارت گندم 1971 و کنوانسیون کمک غذائی 1971 که هر دو در سال 1978 به وسیله پروتکل تمدید شده - در تاریخ 30 ژوئن 1979 منقضی خواهد شد.
متون پروتکلهای 1979 برای پنجمین تمدید کنوانسیون تجارت گندم 1971 و کنوانسیون کمک غذائی 1971 را تهیه نموده است.
پروتکل 1979 برای پنجمین تمدید کنوانسیون تجارت گندم 1971
دول عضو این پروتکل -
با توجه به اینکه مدت اعتبار کنوانسیون تجارت گندم 1971 (که از این پس «کنوانسیون» نامیده خواهد شد) از موافقت نامه بینالمللی گندم 1971 که به وسیله پروتکل در سال 1978 تمدید شده - در تاریخ 30 ژوئن 1979 منقضی خواهد شد - به شرح زیر موافقت نمودند:
ماده 1
تمدید - انقضاء مدت و اختتام کنوانسیون
بر طبق مفاد 2 این پروتکل - کنوانسیون تا تاریخ 30 ژوئن 1981 بین کشورهای عضو پروتکل لازم الاجراء خواهد بود مشروط بر آنکه اگر موافقت نامه بین المللی جدیدی در خصوص گندم قبل از تاریخ 30 ژوئن 1981 بمرحله اجرا در آید - این پروتکل فقط تا تاریخ لازم الاجراء شدن موافقت نامه جدید معتبر خواهد بود.
ماده 2
مفاد بلا اثر کنوانسیون
از تاریخ اول ژوئیه 1979 موارد زیر از مقررات کنوانسیون بلااثر خواهد بود:
(الف) بند 4 ماده 19
(ب)مواد 22 تا 26 (شامل 26)
(ج) بند 1 ماده 27
(د) مواد 29 تا 31 (شامل 31)
ماده 3
تعریف
هر گونه ذکری از «دولت» یا «دولتها» در این پروتکل شامل اشاره به جامعه اقتصادی اروپا (که از این پس «جامعه» نامیده میشود) تلقی خواهد شد. بهمین ترتیب در این پروتکل هر گونه ذکری از «امضاء» یا تودیع اسناد تصویب، پذیرش، تایید یا انعقاد» یا «سند الحاق» و یا «اعلامیه اجرای موقت» توسط یک دولت - در مورد جامعه چنان تلقی خواهد شد که شامل امضا یا اعلام اجرای موقت از طرف جامعه به وسیله مقام ذیصلاح آن و تودیع سند مورد نیاز طبق رویههای اداری جامعه که لازمه انعقاد هر قرارداد بینالمللی است، باشد.
ماده 4
امور مالی
سهم اولیه قابل پرداخت هر یک از کشورهای صادر کننده یا وارد کننده که طبق قسمت (ب) بند (1) ماده (7) به این پروتکل ملحق میشوند توسط شورا بر اساس آرائی که به آن کشور تعلق خواهد گرفت و مدتی که از سال زراعی جاری باقیمانده است تعیین خواهد شد ولی مقدار تعیین شده برای سایر کشورهای عضو صادر کننده و وارد کننده برای سال زراعی جاری تغییری نخواهد کرد.
ماده 5
-امضا
این پروتکل از تاریخ 25 آوریل 1979 لغایت 16 مه 1979 برای امضای کشورهای عضو کنوانسیون تمدید شده به وسیله پروتکل 1978 یا کشورهائیکه در تاریخ 21 مارس 1979 عضو موقت کنوانسیون تمدید شده به وسیله پروتکل 1978 محسوب میگردند یا کشورهائیکه عضو سازمان ملل متحد، سازمانهای تخصصی آن و یا سازمان بینالمللی انرژی اتمی میباشند و نام آنها در فهرستهای ضمیمه (الف) و (ب) کنوانسیون قید شده، در واشنگتن مفتوح خواهد بود.
ماده 6
تصویب، پذیرش، تایید یا انعقاد
این پروتکل موضوع تصویب، پذیرش و تایید یا انعقاد هر دولت امضا کننده بر طبق قوانین اساسی یا مقررات سازمانی دولت مربوطه خواهد بود. اسناد تصویب، پذیرش و تایید یا انعقاد باید تا تاریخ 22 ژوئن 1979 نزد دولت ایالات متحده امریکا تودیع گردد مگر اینکه شورا این ضربالاجل را یک یا چند بار برای دولت امضا کنندهایکه اسناد تصویب، پذیرش، تایید یا انعقاد را تا تاریخ فوق تودیع ننموده است تمدید نماید.
ماده 7
الحاق
1 - این پروتکل به شرح زیر جهت الحاق مفتوح خواهد بود:
الف - تا تاریخ 22 ژوئن 1979 برای الحاق دولتهای عضویکه در آن تاریخ در فهرستهای (الف) یا (ب) کنوانسیون قید شدهاند. شورا میتواند این ضرب الاجل را یک یا چند بار در مورد دولتی که تا تاریخ فوق سند الحاق خود را تودیع ننموده است تمدید نماید - و
ب - بعد از تاریخ 22 ژوئن 1979 برای الحاق هر دولت عضو سازمان ملل متحد یا سازمانهای تخصصی آن یا سازمان بینالمللی انرژی اتمی به موجب شرایطی که شورا مقتضی بداند با دو سوم آراء کشورهای صادر کننده و دو سوم آراء کشورهای وارد کننده.
2 - الحاق با تودیع سند الحاق نزد دولت ایالات متحده امریکا رسمیت مییابد.
3 - هر جا به منظور اجرای کنواسیون و این پروتکل به اعضای مندرج در فهرستهای ضمیمه (الف) یا (ب) کنوانسیون اشاره شود نام هر کشور عضوی که دولت متبوعه آن بر طبق شرایطی که شورا مقرر داشته به کنوانسیون و یا طبق مفاد قسمت (ب) بند (1) این ماده به پروتکل ملحق شده باشد باید مندرج در فهرست ذیربط ضمیمه تلقی گردد.
ماده 8
اجرای موقت
هر دولت امضا کننده میتواند اعلامیه اجرای موقت این پروتکل را نزد دولت، ایالات متحده امریکا تودیع نماید. همچنین هر دولت دیگر حائز شرایط برای امضا این پروتکل یا هر دولتی که در خواست الحاق آن به تصویب شورا رسیده باشد میتواند اعلامیه اجرای موقت نزد دولت ایالات متحده امریکا تودیع نماید. هر دولتی که چنین اعلامیهای را تودیع مینماد مفاد این پروتکل را به طور موقت اجراء خواهد نمود و موقتاً طرف این پروتکل بشمار خواهد رفت.
ماده 9
لازمالجراء شدن
1 - این پروتکل فیمابین دولتهائیکه اسناد تصویب، پذیرش، تایید، انعقاد یا الحاق و یا اعلامیه اجرای موقت را بر طبق مواد (6) و (7) و (8) این پروتکل تا تاریخ 22 ژوئن 1979 تودیع نمودهاند به ترتیب زیر لازم الجرا خواهد گردید:
(الف)- در تاریخ 23 ژوئن 1979 نسبت به کلیه مقررات کنوانسیون به جزمواد (3) تا (9) و ماده (21) - و
(ب) - در تاریخ اول ژوئیه 1979 نسبت به مواد (3) تا (9) و ماده (21) کنوانسیون - در صورتی که چنین اسناد تصویب، پذیرش، تایید، انعقاد یا الحاق و یا اعلامیههای اجرای موقت تا تاریخ 22 ژوئن 1979 از طرف دول صادر کننده عضو که 60 د رصد آراء قید شده درفهرست ضمیمه (الف) را در دست دارند و همچنین دول وارد کننده عضو که 50 درصد آراء قید شده د رفهرست ضمیمه (ب) را در دست دارند یا اینکه اگر در همان روز عضو کنوانسیون میشدند همان تعداد آراء را در دست میداشتند، تودیع شده باشد.
2 - این پروتکل د رمورد هر دولتی که سند تصویب، پذیرش، تایید، انعقاد یا الحاق را طبق مقررات مربوطه این پروتکل بعد از تاریخ 22 ژوئن 1979 تودیع مینماید از تاریخ تودیع لازمالاجرا خواهد شد هیچ یک از مقررات این پروتکل در مورد چنین دولتی لازم الاجراء نخواهد شد مگر اینکه قبلا در مورد دول دیگر طبق بندهای (1) یا (3) این ماده به موقع اجراء در آمده باشد.
3 - د رصورتی که این پروتکل طبق بند (1) این ماده لازم الاجراء نگردد دولتهائیکه اسناد تصویب، پذیرش، تایید، انعقاد یا الحاق یا اعلامیه موقت را تودیع کردهاند میتوانند با توافق متقابل تصمیم بگیرند که این پروتکل فیمابین دولتهائیکه اسناد تصویب، پذیرش، تایید، انعقاد یا الحاق یا اعلامیه اجرای موقت را تودیع نمودهاند لازم الاجرا شود.
ماده 10
اعلام به وسیله دولت نگهدارنده اسناد
دولت ایالات متحده امریکا به عنوان دولت نگهدارنده اسناد مراتب امضا تصویب، پذیرش، تایید، انعقاد، اجرای موقت الحاق به این پرتکل ونیز کلیه اطلاعیهها - یادداشتهای واصله طبق ماده (27) کنوانسیون و هرگونه اعلامیه و اطلاعیه واصله طبق ماده (28) را بتمام دولتهای امضا کننده و ملحق شونده این پروتکل ابلاغ خواهد نمود.
ماده 11
نسخه گواهی شده پروتکل
در اولین فرصت ممکن پس از لازم الجرا شدن قطعی این پروتکل دولت نگهدارنده نسخ گواهی شده متون انگلیسی، فرانسه، روسی و اسپانیولی پروتکل را برای دبیر کل سازمان ملل متحد جهت ثبت طبق ماده (102) منشور ملل متحد ارسال خواهد داشت. هرگونه اصلاحیه در مورد این پروتکل نیز بهمین منوال به اطلاع خواهد رسید.
ماده 12
ارتباط مقدمه با پروتکل
این پروتکل مقدمه بر پروتکلهای پنجمین تمدید موافقتنامه بینالمللی گندم 1971 را شامل میباشد.

CONSTITUTING THE INTERNATIONAL WHEAT

PREAMBLE
The Conferens to eastblish the text of the 1979 Protocol for the fifth extension of the conventions contituting the international Wheat agreement , 1971 Considering that the International Wheat Agreement of 1979 was revised , reneved or extended in 1935 , 1956 , 1959 , 1962 , 1965 , 1966 , 1967 , 1968 , 1971 , 1974 , 1975 , 1976 and 1978
Considering that the International Wheat Agreement , 1971 , Consisting of two separate legalinstruments, the Wheat Trade Convention , 1971 and the Food Aid convention , 1971, both of which waere furtherextended by Protocol in 1978 , will expire on 30 june 1979,
Has easablished the text of the 1979 Protocols for the fifth extension of the Wheat Trade Convention, 1971 and for the fifth extention of the Food Aid CONVENTION ,1971.
1979 PROTOCOL FOR THE FIFTH
EXTENSION OF THE WHEAT TRADE
CONVENTION ,1971
The Governments party to this Protocol:
Considering THAT THE WHEAT TARDE Convention , 1971(hereinafter referred to as the convention) of the Intrnatinal wheat agreement , 1971 , which was futher extended by Protocol in 1978 , extpires on 30 june 1979,
Have agred ar follows:
ARTICLE 4
Extension , expiry termination of the convention
Subject to the provisisions of artile 2 of this Protocol , the convention shall continue in force between the parties to this Protocol until 30 june 1981 provided that , if anew inter national agreement covering wheat enters into force before 30 june 1981 this Protocol shall remain in forse only until the date of entry into force of the new agreement.
ARTICLE 2
Inopertive provisions of the convention
The following Provisions of the Convention shall be deemed to be inoperative with effect from 1 July 1979:
(a) paragraph (4) of article 19:
(b) articele 22 to 26 inclusive ;
(c) paragraph (1) of Article 27;
(d) Articles 29 to 31 inclosive.
ARTICLE 3
Definition
Any reference in this protocol to a Governments or Governments shall be construed as including a refrence to the European Economic (hereinafter refrerred to as the Community).Accordingly ,any refrence in this Protocol to ,,signature,,or to the ,,deposit of ratification ,acceptance, approval or or conclusion ,, or,,an insrtrument of accession ,, or ,,a declaration of provisional application ,, bya government shall ,in the case of the community, be construed as including signature or declaration of provisional application on behalf of the community by its competent authority and the deposit of the instrument required by the institutional procedures of the community to be deposited for the conclusion of an international agreement.
ARTICLE 4
Finance
The initial cotribution of any exporting or importing member acceding to this protocol under paragraph (1) (b) of article 7 there of , shall be assessed by the council on the basis of the votes to be distributed to it and the period remaining in the current crop year, but the assessment made upon other exporting and importing members for the current crop year shall not be alterd.
ARTICLE 5
Signture
This protocol shall be opsn for signature in washington from 25 April 1979 until and including 16 may 1979 by governments of countries party to the convention as fhrther extended by the 1978 protocol , or which are provisionally regarded as party to the convention further extended by the 1978 protocol , on 21 march 1979 , or which are member of the united nations , of its specialized agenciens or of the international atomic engry agency , and are listed in annex a or annex b to to convention
ARTICLE 6
Ratification , acceptance, approval or conclusion
This protocol shall be subject to ratification , acceptanc , approval or conclusion by each signatory government in accordance. Instrument of ratification acceptance , aproval or conclusion shall de deposited whit the government of the united states of america not later than 22 june 1979, exept that the counicil may garant one or more extensions of time to any signatory government that has not deposited its instrument of ratification , acceptance, approval or conclusion by that date.
ARTICLE 7
Accession
(1) this protocol shall be open for accession
(a)until 22 june 1979 by the government of any member listed in annex A or B to the convention as of that date , except that the council may garant one or more extensions of time to any government that has not deposidet its instrument by that date , and
(b)after 22 june 1979 by the government of any member of the united nations, of its specialized agencied or of the intrenational atomatic energy , upon such conditions as the council considers appropriate by not less than two thirds of the votes cast by importing members.
(2)Accession shall be effected by the deposit of an instrument of accession with the government of the united states of america.
(3)where , for for the purposes of the operation of the convention and this protocol , reference is made to members listed in annex A or B to the convention , any member the government of which has acceded to the convention on conditions prescribed by the council , or o this protocol in accordance whit paragraph (1) (b) of this article , shall be deemed to be listed in the approprite annex.
ARTICLE 8
Provisional application
Any signatory government may deposit whit the government of the unated states of america a declration of provisional application of this protocol any other government eligible ti sign this protocol or whose applicatin for accession is aproved by the council may also deposij whit the government of the united states of america a declaration of provisional applicatin. any government depositing such a declaration shall provisionally apply this protocol and be provisionally regarded as a party thereto.
ARTICLE 9
Entry into force
(1) this protocol shall enter into force among those governments which have deposited instruments of ratification , acceptance, approval , conclusion or accession, or declarational application , in accordance whit articles 6,7 and 8 of this protocol by 22 june 1979 as follows:
(a)on 23 june 1979 whit aespect to all provisions of the convention other than article 3 to 9 inclusive and article 21, and
(b) on 1 june 1979 whit respect to article 3 to 9 inclusive , and article 21 of the convention , if such instruments of ratification , acceptance , approval , conclusion or accession , or declarations of provisional application have been deposited not later than 22 june 1979 on behalf of government repressenting exporting members which held at least 60 per cent of the votes set out in annex A and representing importing members which held at least 60 per cent of the votes set out in annex b , or would have held such votes respectively if they had been parties to the convention on that date.
(2)this protocol shall enter in to force for any gover ment that deposist an instrument of ratification acceptance , approval ,conclusion or accession after 22 june 1979 in accordance whit the relevant
provisions of this protocol , on the date or such deposit exept that no part of it shall enters force for such a government until that part enters into force for other government under paragraph (1) or
(3)of this article.
(3)if this protocol dose not enter into force in accordance whit paragraph (1)of this article , the goverments which have deposited instruments of retification , acceptance ,approval , conclution or accession or declaration of provizional application , may decide by mutual consent that it shall enter into force among those governments that have deposited instrument of retification , acceptance , approval , conclusion or accession or declarations of provisional application.
ARTICLE 10
Notificationby depositary government
To government of the united states of america as the depositary government shall notify all signatory and acceding government of each signature , ratification acceptance, approval , conclusion, provisional application of, and accession to , this protocol as well as of each notification and notice received under article 27 of the convention and notification received under article 28 of the convention.
ARTICLE 11
Certified copy of the protocol
As soon as possible after the definitive entry force of this protocol the depositary government shall send a certified copy of this protocol in the English,French,Russian and Spanish languages to the secretary general of the united nations for registration in accordance whit article 102 of the charter of the united nations. Any amendments to this protocol shall likewise be communicated.
ARTICLE 12
Relation if preamble to protocol
This proocol includes the preamble to the 1979 protocol for fifth extension of the International wheat agreemwnt ,1971.
